Terms of use

These terms cover your use of this website and the agent purpose app. By using either, you agree to them. If you do not, do not use the website or the app.

Parties and eligibility

1. Who we are

agent purpose is made and operated by ilovemeerkats, based in Australia. In these terms, “we” and “us” mean ilovemeerkats and the people who work on agent purpose with us, including our contractors.

2. Who can use agent purpose

You must be at least 16 years old to buy or use agent purpose. If you are below the age at which you can consent to using online services where you live, you may use it only with the consent and supervision of a parent or legal guardian, who accepts these terms on your behalf.

The app

3. The app and the App Store

agent purpose is sold as a one-time purchase, with no subscription. This website is informational and does not sell the app.

The macOS version is sold through the Mac App Store, and Apple handles that sale. Your licence to install and run it is granted by Apple under its standard Licensed Application End User License Agreement, and Apple’s terms apply to that purchase alongside these. These terms cover ownership, your content, warranty, liability and governing law.

We may add to or change the app over time. Where a change would require a further payment, you will not be charged unless you choose to buy it.

4. Data responsibility

Your entries, notes and everything else you record stay as files on your own computer, not on our servers. You are in control of that data, and you are responsible for keeping it. If you delete the files or lose the machine, we cannot recover them for you. Keep your own backups. If you subscribe to the newsletter, that is covered in the privacy policy.

5. Intellectual property

agent purpose and everything that makes it work belong to ilovemeerkats. This includes the agent purpose name and branding, the visual design and interface, the text and copy throughout the app, the underlying code, and the way the app is put together, including its application logic and its flows. All of it is our intellectual property and is protected by copyright and other laws.

We give you a personal, non-exclusive, non-transferable right to use agent purpose for your own use under these terms. You may not copy, sell, redistribute, modify or reverse-engineer it without our written permission.

Anything you record with the app remains yours. Because that content stays on your own device, we make no claim to it.

General

6. No warranty, and limited liability

agent purpose is provided “as is”, with no warranties. We do not promise that it will be error-free or suitable for every purpose.

Nothing in these terms excludes any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded, or any right you have under the consumer law where you live.

Otherwise, to the extent the law allows, we are not liable for any loss or damage arising from your use of agent purpose. This includes, but is not limited to, indirect, incidental, special and consequential loss, lost profits, business interruption, and lost or corrupted data. Where our liability cannot be excluded, it is limited to the amount you paid for the app. Refunds for an App Store purchase are handled by Apple.

7. Severability

If any part of these terms is found to be invalid or unenforceable, that part is removed and the rest stays in effect.

8. Changes, governing law and contact

We may update these terms from time to time. The date above shows when they last changed. These terms are governed by the laws of Victoria, Australia, and you agree to the non-exclusive jurisdiction of its courts. You can reach us through the contact form on our website.
